1. Acceptance of Terms

By accessing or using SafeWalk ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service. We reserve the right to update these terms at any time. Continued use after changes constitutes acceptance.

2. Description of Service

SafeWalk is an AI-powered personal safety companion that monitors your location via GPS, detects anomalies in your movement patterns, and automatically notifies your designated emergency contacts if something appears wrong. Features include:

Real-time GPS tracking and route monitoring
AI-based anomaly detection (unexpected stops, route deviations, sprinting)
Automated SMS and voice alerts to your personal emergency contacts
"Dead man switch" — alerts if you become unresponsive
One-tap manual escalation
SafeRoute — AI-optimized routing through safer areas
Push notifications for walk status and alerts
Optional audio recording during alert events

SafeWalk does NOT contact 911 or any emergency services on your behalf. The Service contacts only the personal emergency contacts you designate. In any emergency, you must call 911 or local emergency services yourself.

3. NOT a Replacement for Emergency Services

CRITICAL: SafeWalk is a supplementary safety tool. It is NOT a replacement for 911 or local emergency services. SafeWalk does not call 911, police, ambulance, or any emergency services. The Service only contacts the personal emergency contacts you have manually added to your account.

In an immediate life-threatening emergency, you must call emergency services directly. SafeWalk relies on cellular data, GPS signals, and third-party services (SMS gateways, push notifications) — any of which can fail. We make no guarantee that alerts will be delivered to your personal contacts in time or at all.

3.1 No Guarantee of Safety

Use of SafeWalk does not guarantee your personal safety. The Service provides monitoring and alerting capabilities; it cannot prevent harm. You remain responsible for your own safety decisions.

4. User Responsibilities

By using SafeWalk, you agree to:

Provide accurate and current emergency contact information
Obtain consent from your emergency contacts before adding them to the Service
Not use the Service for illegal activities, harassment, stalking, or any purpose that violates the rights of others
Not misuse the emergency alert features (false alerts may result in account termination)
Keep your device charged and maintain cellular/GPS connectivity while using tracking features
Be at least 13 years of age (or the age of digital consent in your jurisdiction)

5. Location Data & Privacy

SafeWalk requires access to your device's GPS location to function. Location data is transmitted to our servers only while a walk is active and is used to:

Monitor your route for anomalies
Share your real-time location with emergency contacts during an alert
Calculate SafeRoute recommendations based on neighborhood safety data

Location tracking stops when you end a walk. Location data is not sold, shared with advertisers, or retained beyond what's necessary to provide the Service. See our Privacy Policy for full details.

6. AI & Automation Limitations

SafeWalk uses artificial intelligence (OpenAI GPT-4o-mini) to analyze movement patterns and detect potential threats. AI-based threat detection is probabilistic and may produce:

False positives — incorrectly flagging normal behavior as concerning
False negatives — failing to detect genuinely dangerous situations

You acknowledge these limitations and agree that SafeWalk's AI analysis is advisory in nature, not definitive. We continuously improve our detection models but cannot guarantee perfect accuracy.

7. Third-Party Services

SafeWalk relies on third-party services including but not limited to:

Twilio — SMS and voice call delivery
Mapbox — mapping and routing
OpenAI — AI threat detection and SafeRoute analysis
Firebase Cloud Messaging — push notifications
DigitalOcean — server hosting

We are not responsible for failures, outages, or data handling practices of these third-party providers. Message and data rates from your mobile carrier may apply for SMS alerts.

8. Account & Access

You are responsible for maintaining the confidentiality of your account credentials. We may suspend or terminate your access to the Service at our discretion, particularly in cases of misuse, false alerts, or violation of these terms.

9. Payment & Subscriptions

SafeWalk currently offers a free tier. Future premium features (extended recording, advanced analytics, API access) will be offered via in-app purchases. Pricing and feature details will be communicated before any charges are incurred. All purchases are final and non-refundable unless required by applicable law.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

SafeWalk is provided "as is" without warranties of any kind, express or implied
We are not liable for any damages arising from use or inability to use the Service, including but not limited to personal injury, death, property damage, emotional distress, or financial loss
Our total liability for any claim shall not exceed the amount paid by you for the Service in the 12 months preceding the claim, or $50 USD, whichever is greater
We are not liable for failures caused by circumstances beyond our reasonable control (network outages, GPS unavailability, third-party service failures, force majeure)

11. Indemnification

You agree to indemnify and hold harmless SafeWalk, its owners, operators, and affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

12. Dispute Resolution

Any disputes arising from these terms or the Service shall be governed by the laws of the State of California, without regard to conflict of law principles. Disputes shall be resolved through binding arbitration in San Diego County, California, unless prohibited by applicable law.

13. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions regarding limitation of liability, indemnification, and dispute resolution survive termination.

14. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via the Service or email. Your continued use after changes take effect constitutes acceptance.
